The parties involved:
Chic Gites is the registered trade name of SARL Helen, a professional rental company incorporated in Cannes since 2007. It is represented by Niall Bates, its Managing Director. It will be referred to as "The Owner".
"The client" refers to the signatory (digital or handwritten) of the booking form. A signed, returned
booking form will be taken as acceptance of the below terms and conditions in relation to the rental contract.
Bookings:
A booking will not be reserved until the booking form has been returned, signed, and the 50% booking deposit has been received. At that point the booking is reserved until 1 month prior to arrival.
The booking will be confirmed once final payment and security deposit has been received. This will normally be one month prior to arrival. Failure to pay in a timely manner can result in your booking being cancelled without any refund of monies paid.
Booking cannot be accepted from anyone under the age of 18 years at time of booking.
Payment:
We can accept payment by all major credit cards or by bank transfer. Cash or cheque payments may be accepted at the discretion of the owner, but only if agreed prior to booking.
Under no circumstances will access to the property be given unless the rental price and security deposit have been received in full.
Rental Price:
All prices are quoted in Euros. All prices quoted on the website or by direct correspondance are subject to change. Only when receipt of the correct booking deposit is confirmed by the owner, is the price for the rental confirmed. Any changes prior to this point are at the discretion of the owner.
Included in the Rental Price:
Towels and Linen for your stay.
Local taxes (taxe de sejour) and TVA (French Value Added Tax)
Cleaning before arrival and after departure
Meet and Greet at the apartment on arrival. In exceptional circumstances we will provide an arrival pack at a nearby drop-off point.
Wi-Fi internet access
Normal Water and Electric consumption - in the case of unreasonable use (to be decided by independent expert) the excess charge will be at the client's expense.
Not Included in the Rental Price:
Insurance - it is absolutely vital that clients are insured for their stay. Both in terms of personal belongings and 3rd party liability, neither of which are covered by the owner. Under no circumstances whatsoever will the owner be liable for the client's or any other guests' belongings.
Additional Services such as additional linen, additional cleaning etc.
Any damage caused to the property or any of the furnishings during the rental period.
Security Deposit:
A security deposit of up to €1000 (depending on rental property and period) will be required for each rental. In the case of damage to the property or its contents during the rental period, the cost of repair or replacement will be deducted from the security deposit. Please note, the client's liability is not limited to the amount of the security deposit paid. We will normally endeavour to refund the security deposit (less any cost of damage) within 48 hours of departure, subject to banking delays or quotes for repair to damage. Please note, deposits paid by cash or bank transfer will be refunded by bank transfer; payments by credit card will be refunded to the card used to pay them.
Cancellation/Amendments by the Owner:
If the client breaches any of the rental conditions stipulated in this agreement, the owner may, without notice or refund cancel the rental contract and evict the client and all guests immediately.
In the unlikely event that it is necesary for the owner to make any changes or cancellation to the booking prior to arrival, we will inform you at the earliest possible moment. At the request of the client we will endeavour to find similarly located and priced alternative accommodation. In the event of this not being possible, or at the request of the client, all monies paid will be refunded. Please note, our liability in case of amendment or cancellation cannot exceed the total monies paid.
Cancellation/Amendment by the Client:
In the event of amendment of a booking, the owner may at their entire discretion, accommodate such changes, or not, and subject to any price changes applicable.
In the event of cancellation by the client: One month or more prior to arrival - the 50% booking deposit will be lost. Within one month of arrival, the full rental fee will be lost.
In the event of early departure, no refund will be made.
In order to avoid cancellation fees we strongly encourage the client to have a comprehensive travel insurance policy to cover rental fees lost in such circumstances.
Arrival/Departure times:
The rental contract begins at 16h (local time) on the day of arrival and ends at 11h (local time) on the day of departure. Where possible we will try to accommodate early arrivals and late departures but this in entirely at the owner's discretion.
Number of People at the Accommodation:
The number of people sleeping at the accommodation must not at any point exceed the number of people stated (and agreed by the owner) on the booking form. The owner must be informed of any changes to the list of guests if different from those stated on the booking form. Although temporary visitors, not numbering more than the total number of sleeping guests allowed, are allowed in the apartment during the day, from 22h to 08h (local time) all temporary visitors must have left the apartment, leaving, at most, the guests named on the booking form. Failure to comply with this can result in your booking being cancelled by breach of terms and conditions of your rental agreement.
Access to the Apartment:
The owner may, at any reasonable time, access the apartment without prior permission from the client, in order to carry out emergency maintenance (to fix a leak for example) or for inspection in the case of suspect breach of the terms and conditions of the rental agreement.
Information and Pictures:
All efforts are made to ensure the information (written and photographic) on our website is accurate, but we cannot accept any liability for any potential errors.
The owners reserve the right to make changes to properties such as changes to furnishings, decoration etc. All such changes will be either as part of maintenance or with the aim of improving the comfort during a stay. Such changes will be made in good faith.
In the unlikely case of any significant changes to the layout of the apartment prior to client arrival, the client will be informed and allowed to cancel their booking with full refund of monies paid.
Pets:
Unfortunately no pets are allowed inside any of our properties. Failure to comply with this rule will result in the client being liable for full professional cleaning and repair costs as well as having the rental contract cancelled with immediate effect.
Smoking:
All of our apartments are non-smoking throughout, including on outdoor/balcony areas. Failure to comply with this rule will result in the client being liable for full professional cleaning cost as well as any additional loss of earnings by the owner during the cleaning period. It will also result in the immediate cancellation of the rental contract.
Client Responsibilities:
It is your responsibility to keep the apartment in a fit and reasonable state at all times, including departure. All furnishings and fittings must be returned in the same state they were received at the start of the booking. You are responsible for all loss or damage to all contents of the apartment, including the keys received on arrival.
The client agrees to be a considerate tenant, to take good care of the property, to leave it in a clean and tidy condition on departure. In the case of the client leaving the property in an unacceptable condition, the client will be liable to additional cleaning costs above and beyond those included in a "final clean". The client agrees to not to behave in any way as to cause disturbance to residents in neighbouring properties, notably noise, smell or rubbish. If the client fails to behave in such a considerate manner, or indeed fails to abide by any of the terms and conditions, the owner may, without notice, terminate the rental contract and evict the client and all guests.
Problems during your stay:
In the case of any problems or disputes during your stay, the owner should be notified immediately. In the case of any breakdowns of equipment, we will repair or replace as soon as possible. If for any reason you are not happy with the property or feel it does not match the written/photographic description, we will endeavor to resolve the issues immediately. Please note however, any early departure will be non-refunded.
Owner Liability:
The owner shall not be liable for the following events:
- Any temporary stoppage in a public service provided by a 3rd party such as, but not limited to, electricity, wifi, cable TV, water.
- Loss, damage or injury to the client, guests or temporary visitors to the property during the rental period.
- Loss, damage or injury to the client, guests or temporary visitors to the property caused by the weather, public strikes, war, or any other matters beyond our control.
- Any loss or inconvenience caused to the client or guests in the event of substantial damage to or loss of the property prior to the start or during the rental period which results in the property being uninhabitable. In such circumstances will endeavor where possible to reaccommodate the client and guests in suitable alternative accommodation. If we are unable to do so, all monies paid will be refunded to the client.
- Any loss of or damage to client property during the rental period for whatever reason.
In all respects, our maximum liability will be limited to the monies paid by the client.
Law:
All contractual obligations relating to this rental will come into existence in Cannes, France irresepective of the location of the client when the contract was signed. Any disputes arising from said contract will be subject to french law and the exclusive jurisdiction of the Cannes courts.
